Not only is it pretty well false, they're also using actors for these commercials, not the “regular guy” Microsoft is leading you to believe. I think it was Engadget or Gizmodo that ended up tracking down the woman in the initial commercial. I also find it fishy that they're only picking out HP's.
Once you add up all the additions that Apple just simply includes, it can get pretty pricey. Also, there's that whole virus thing.

Does this always happen? In my belief absolutely not. This I feel is for many reasons. Parents and families aren't qualified to do so. And, they don't have the time, don't feel they should, don't want to because of laziness, or a host of other reasons that sociologists should study.

Good post. I am the attorney who represented Cassondra Todd against Guidance Software. I agree that an obligation to search back-up tapes as part of the customary discovery process would not be reasonable as such documents on back-up would not be considered “reasonably accessible” under the Federal Rules of Civil Procedure. In our case, however, the judge determined that Guidance had not complied with its initial discovery obligations. Facing the possibility of having the judge entered default in Ms. Todd's favor, Guidance claimed that it could not comply with its disccovery obligations because a year earlier (shortly after Ms. Todd's termination) it has experienced a massive corruption of its email database. At the time of the alleged data corruption Guidance had no formal back-up policy and undertook no recovery efforts. The judge determined that Guidance's failure to have a back-up policy in place and the fact that it undertook no recovery efforts at the point of corruption consituted gross negligence. It was only as part of a discovery sanctions order after these factual findings, did the judge order Guidance to search whatever back-up tapes it did have. It was not part of Guidance's initial discovery obligations. Thank for your allowing me to clarify this.
